The NY Court is going after President Trump for an alleged crime that the Feds declined to pursue. Elevating a business records misdemeanor to a federal crime for an alleged undisclosed underlying crime is not going to hold up on appeal. All businesses choose to settle some internal matters and threatened litigation and it is noted as legal expenses accounting wise. So yes, NY does play...but foolishly.

Its my understanding that this sara person was under the condition to not reveal anything. NDA clause , etc. No where did it say John had to keep his trap shut.
