Elevating a business records misdemeanor to a federal crime for an alleged undisclosed underlying crime is not going to hold up on appeal. All businesses choose to settle some internal matters and threatened litigation and it is noted as legal expenses accounting wise. So yes, NY does play...but foolishly.
